Introduction

Nexassure Global Logistics (referred to as “Nexassure,” “we,” “our,” or “us”) provides courier, freight forwarding, customs facilitation and related logistics services. These Terms of Use (“Terms”) govern your access to and use of our website, online tools, and any services you book with Nexassure. By accessing our website, creating an account, placing bookings, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use our services.

Services

We arrange and provide a range of logistics services, including express courier pickups and deliveries, international exports, freight forwarding, customs brokerage support, and value-added services such as packing, warehousing, and returns management. The exact scope of services for any shipment is outlined in the booking confirmation, the applicable service order, and any written agreements between you and Nexassure.

Eligibility

You must be at least 18 years old and legally capable of entering into contracts to use our services. If you are booking on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Your Obligations

When you use Nexassure you agree to:

  • Provide complete, accurate and current information for bookings, shipments, customs requirements, billing and contact details.
  • Package, label and describe goods honestly and accurately, including correct value, content, and any special handling instructions.
  • Comply with all applicable laws, export/import controls, sanctions and customs requirements for the origin, transit and destination countries.
  • Not ship prohibited, restricted, hazardous, or illegal items (see “Prohibited Items” below).
  • Cooperate with Nexassure and our partners during shipment handling, customs clearance, and any claims investigation.

Bookings & Shipments

  • All bookings are subject to availability, capacity, and acceptance by Nexassure or our carrier partners.
  • Booking confirmations are only binding when issued by Nexassure in writing (which may include email).
  • Estimated delivery times are provided as guidelines and are not guaranteed unless a specific service guarantee is expressly confirmed in writing. Delays can occur due to customs, force majeure, or carrier operational issues.

Prohibited Items

You must not ship items that are illegal or prohibited by applicable law or by the carrier’s rules. Typical examples include:

  • Explosives, flammable materials, toxic or radioactive substances.
  • Illegal drugs, controlled substances, and drug paraphernalia.
  • Weapons or components that are subject to export controls.
  • Counterfeit goods, stolen property, or items that infringe third-party intellectual property rights.

If you attempt to ship prohibited items, we may refuse, suspend, or terminate the booking and you will be responsible for all costs, fines, penalties and any losses arising from the prohibited shipment.

Pricing & Payment

  • Prices, fees, and charges for services are set out in the booking confirmation, invoice, or our published rate schedule. Rates exclude applicable taxes, duties, surcharges, and any third-party fees unless otherwise stated.
  • Payment terms are set in the invoice or booking confirmation. Unless otherwise agreed, invoices are due when issued. Late payments may incur interest or collection costs.
  • We use third-party payment processors to handle card and electronic payments. Nexassure does not store full payment card numbers unless explicitly agreed and tokenized under a third-party service.

Taxes, Duties & Customs Charges

In most cases, the consignee (receiver of the shipment) is responsible for paying any customs duties, taxes, import fees, or other governmental charges assessed at destination. If the consignee refuses or fails to pay, the shipper remains liable for these charges. Where Nexassure or its partners pay such amounts on behalf of the consignee or shipper, you agree to reimburse us promptly for all related costs.

Insurance & Declared Value

  • Basic liability for loss or damage is governed by these Terms and, where applicable, by the terms of the carrier or international conventions. We recommend that you obtain adequate insurance for high-value goods.
  • If you declare a value for carriage, any extra liability or coverage will be limited to the declared value and subject to the applicable carrier’s terms and our written acceptance. Declared value does not necessarily replace the need for separate cargo insurance.

Pickup & Delivery

  • We will make reasonable efforts to adhere to scheduled pickups and deliveries. Delivery attempts, storage, and re-delivery may be subject to additional charges.
  • If a shipment cannot be delivered (for example, due to incorrect address, refusal by consignee, or customs hold), we may return the shipment to sender, store it, or dispose of it under applicable law. Any reasonable costs incurred will be charged to you.

Customs & Regulatory Clearance

  • For international shipments, you must provide all information and documentation required for customs clearance, including accurate descriptions, values, and harmonized system (HS) codes where requested.
  • Nexassure may provide customs brokerage support but is not responsible for customs delays, fines, penalties, or seizures resulting from incorrect or incomplete documentation supplied by you.

Third-Party Carriers & Partners

  • We often use third-party carriers, agents, and subcontractors to perform services. Your contract for carriage may be with a carrier or other provider rather than Nexassure directly. In such cases, the terms and conditions of those carriers apply to that leg or service.
  • We act as an intermediary and coordinator; we are not the carrier unless explicitly stated in writing. We are not responsible for the policies, practices, or performance of third parties, except to the extent required by law.

Claims & Liability

  • You must inspect deliveries on receipt and notify us promptly of loss, shortage or damage. For damaged goods, retain packaging and photographic evidence. Claims must be made in accordance with the claims process stated in your booking confirmation or invoice.
  • To the fullest extent permitted by law, Nexassure’s liability for loss, damage, or delay arising from or in connection with any shipment is limited to the lesser of:
    • The declared value of the goods for carriage (if accepted by us in writing), or
    • The total shipping charges paid for that shipment, or
    • Any liability cap imposed by applicable law or the relevant carrier’s terms.
  • We are not liable for: indirect, special, incidental, consequential, or punitive damages, including loss of profit, loss of business, or loss of goodwill, even if advised of the possibility of such damages.
  • Time limits: You must submit claims and supporting documentation within the timeframes specified in your booking confirmation or invoice. If no timeframe is specified, you must notify us of loss or damage promptly and no later than 30 days from the scheduled delivery date for loss, and 7 days from delivery for visible damage. (Please check your booking confirmation for exact deadlines.)

Indemnity

You agree to indemnify, defend and hold Nexassure and its affiliates, officers, employees and agents harmless from any claims, losses, liabilities, damages, fines or expenses (including legal fees) arising from your breach of these Terms, your negligent or unlawful acts, or your shipment of prohibited or restricted items.

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Nexassure or our licensors and is protected by intellectual property laws. You may not copy, reproduce, or use our trademarks or website content without our prior written consent.

Termination & Suspension

We may suspend or terminate your access to our services or website at any time for cause, including breach of these Terms, non-payment, or suspected illegal activity. Termination does not affect any accrued rights or liabilities.

Force Majeure

We are not responsible for failure or delay in performing obligations caused by events beyond our reasonable control, including natural disasters, strikes, pandemics, government actions, war, terrorism, or carrier insolvency. In such cases, performance obligations are suspended for the duration of the event.

Changes to These Terms

We may modify these Terms at any time with or without prior notice. Any updated Terms will be posted on our website and take effect when posted. It is your responsibility to review these Terms regularly. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.

Electronic Communications

By using our website and services you agree to receive electronic communications from us (such as email or SMS). These communications satisfy any legal requirement that such communications be in writing.

Disclaimer

Except as expressly stated in these Terms, Nexassure provides services “as is” and disclaims all warranties, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement to the maximum extent permitted by law.

Governing Law & Jurisdiction

These Terms are governed by the laws of India. You agree that the courts of Chennai, Tamil Nadu, India will have exclusive jurisdiction to resolve disputes arising under or in connection with these Terms, to the extent permitted by law.

Severability & Waiver

If any provision of these Terms is held invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force. Failure to enforce a right is not a waiver of that right.
